Commercial Debt Laws

Unlike in several cities around the US, Des Moines has a considerable amount of transparency on their commercial debt collection laws. For consumer debt collection practices, collection agencies must adhere to the guidelines of the federal Fair Debt Collection Practices Act (FDCPA) to ensure they treat with respect any consumers that owe debt to creditors. But the FDCPA doesn’t work with commercial debt collection. As a result, many states and cities must create their own list of business debt collection guidelines.

In Des Moines and Iowa, the business debt collection statute of limitations is 5 years for oral contracts, 10 years for written contracts and judgments, and up to 20 years for foreign judgments. If a debtor attempts to pay a debt with a bad check, the laws in Iowa state that service surcharges must not exceed $30 and not be assessed unless the debtor clearly posts notice in advance of payment due date. If a debtor simply stops making payments toward a debt, the surcharge will not be assessed against the debtor.
